Eviction of housing association tenants Print E-mail

Most housing associations have to follow the same legal procedure as the Housing Executive before evicting you. Contact an adviser if your housing association is trying to evict you.

Secure housing association tenants

Most housing association tenants are secure tenants. Contact your housing association if you are unsure whether or not you are a secure tenant.

Secure housing association tenants have the same rights as someone who is renting from the Housing Executive. The section on eviction from Housing Executive accommodation has more information on how the eviction process works.

Unsecure housing association tenants

If you are an unsecure tenant your housing association can evict you by following the eviction procedure for private tenants.

Tenants of unregistered housing associations

Some housing associations are run as businesses, and are not registered with the Department for Social Development. In this case, your housing association will have its own eviction procedure. You are usually only guaranteed 28 days' notice to quit.

If your housing association is not on the DSD's list of registered housing associations, it is probably an unregistered housing association. Check with your landlord if you're not sure what kind of tenancy you have.

Getting advice

The Housing Executive has a duty to provide advice on homelessness and its prevention to anyone in Northern Ireland who asks for it.

Contact a local advice agency if your housing association wants to evict you. The eviction process usually takes a few months, and whatever stage of the process you're at, it's always worth getting advice.

An adviser may be able to help get the eviction stopped or delayed. If this is not possible they may be able to help you make steps to find new accommodation.
